Supplier Verification Policy and Origin of Virtual Goods

Legal transition. The operation of VenteKamas is being migrated to GAMEHUB LIMITED, Hong Kong. Until the effective date of the migration, Kamasense Limited remains the operator of the site and this policy applies to transactions carried out under Kamasense Limited.

1. Purpose

Kamasense Limited, which operates the ventekamas.com website (hereinafter "the Company"), purchases virtual goods and game accounts from players. This policy describes the checks applied by the Company in order to reduce the risk of accepting virtual goods that are stolen, fraudulently obtained, compromised or otherwise prohibited.

These checks are based on identification of the transaction, the seller's declarations, the retention of information, the analysis of risk factors and, where necessary, additional verification. They are designed to verify, on a reasonable basis, the ownership and legitimate acquisition of the goods offered; they do not constitute an absolute guarantee.

It applies to any offer submitted to the Company, whether through the kamas selling page, the server-to-server exchange page or the account buy-back page.

2. Ownership requirement

Every seller must confirm that they are the rightful owner of the virtual goods offered, or that they have the right to transfer them. This confirmation is collected at the time of the request and attached to the transaction concerned.

3. Legitimate acquisition requirement

Every seller must confirm that the goods offered were legitimately acquired and that they do not result from fraudulent or prohibited activity. Ownership and legitimate acquisition are two separate requirements: holding an item is not sufficient if it was obtained by prohibited means.

This confirmation constitutes a warranty: the seller is answerable for it under the conditions set out in article 5.

4. Prohibited sources and practices

The Company refuses any virtual goods arising in particular from:

  • theft of virtual goods;
  • compromise, theft or unauthorised use of an account;
  • unauthorised access or hacking;
  • fraud or deception;
  • use of stolen or fraudulent payment methods to acquire the goods;
  • fraudulent chargebacks used to obtain the goods;
  • duplication or cloning of goods;
  • exploitation of a game flaw where it constitutes a prohibited or fraudulent method;
  • falsification of delivery evidence, screenshots, videos or transaction information;
  • false declaration concerning the ownership or origin of the goods;
  • any other illegal or fraudulent activity.

5. Seller's liability

By offering virtual goods for sale, the seller warrants that they are the rightful owner of those goods or that they have the right to transfer them, that these goods were legitimately acquired, and that they do not come from any of the sources or practices listed in article 4. The seller is responsible for the accuracy of this warranty, which is collected for each request and retained with the corresponding transaction.

Where it appears, before or after the transaction, that this warranty has not been complied with, the Company may refuse the transaction, withhold or hold back payment within the limits set by the applicable terms, re-examine previous transactions by the same seller, restrict or block their access to the services, and exercise the applicable contractual remedies.

The seller is answerable for the direct consequences of an inaccurate declaration, in particular the repayment of sums received in respect of goods whose origin proves to be illegitimate. These provisions do not affect the rights that a consumer enjoys under the mandatory provisions applicable to them.

6. Transaction information

Depending on the transaction and the capabilities of its systems, the Company may retain information which may include, in particular:

  • the request or order identifier, the date and the time;
  • the contact details provided by the seller and their means of contact;
  • the payment method selected;
  • the game, the server and, where applicable, the name of the character or account concerned;
  • the type of goods, the quantity and the amount;
  • the delivery status;
  • acceptance of the seller's declaration, the date of that acceptance and the version of the terms accepted;
  • the risk and review status.

7. First-level checks

Any request may be examined in the light of, in particular:

  • the seller's history;
  • the quantity and value of the transaction;
  • the frequency of requests;
  • the consistency of the payment information;
  • the consistency of the character, server or account information;
  • previous incidents or rollbacks;
  • unusual changes in the seller's activity;
  • any other inconsistency or risk signal.

8. Enhanced review

Where a transaction presents one or more risk factors, the Company may place it under enhanced review before accepting or settling it. Depending on the case, it may request:

  • an explanation of how the goods were obtained;
  • the evidence reasonably available attesting to ownership or legitimate acquisition;
  • screenshots or a video;
  • additional information about the in-game transaction or the account concerned;
  • confirmation that the payment account belongs to the seller;
  • the history of previous transactions;
  • any other information reasonably useful for the review.

9. Suspension of payment during verification

Where additional verification is necessary, payment to the seller may be temporarily withheld for the time reasonably necessary for the review, within the limits set by the applicable terms. The seller is informed of this through the means of contact given in their request.

10. Decision

At the end of the review, the transaction may be:

  • accepted;
  • kept on hold pending additional information;
  • refused;
  • accepted with a restriction on the seller;
  • refused with the seller blocked.

Where the information available does not make it possible to establish, on a reasonable basis, the ownership or legitimate origin of the goods, the Company may refuse the transaction. The decision and the material examined are retained.

11. Post-transaction monitoring

A transaction that has already been completed may be re-examined where later information raises a doubt, in particular a rollback, a complaint, a fraud report, a report of a compromised account or repeated anomalies linked to the same seller. A seller's risk status may then be revised.

12. Retention of information

Verification and transaction information may be retained for the purposes of fraud prevention, dispute management, compliance and responding to the requirements of our payment providers, on the conditions and for the periods set out in our privacy policy and by applicable law.
